Ripped off - What can i do?

So I dealt with auto parts direct: http://www.apdautoparts.co.nz/

Warning DO NOT USE THEM

I asked for a late 98/99/early 2000 Sti manifold (he said he doesn't like the term Version when i asked for a V5 manifold) sent me an early 98 one which is v4. Plus he missed a bunch of other parts i asked/paided for (boost solenoid bracket, oil return pipe & heater core lines). I asked about these and he said he thought they were on the manifold. Fail

So i asked for a refund ($170) and sent the bits back

Put the money threw on 15th of june, after weeks of asking them what taking so long the parts finally turned up around the 15th of july, wrong bits >:( so sent back that later that day.

Still haven't received the refund after daily phone calls asking why - everyday theirs an excuse and "ill sort it out today".

I'm sick of it, Anybody know what can i do to get the money back?

You have provable records of said transactions, and also provable records of contact asking for money etc?

send him a "see you in court" letter. That always gets the ball rolling. Include the slander and bad name they now have within "clubsub" nationwide :) be curtious but firm of course

Well yes i have bank records of sending the money, no receipt came with the package. Most of the conversation has been over the phone but i could send an email asking for the money?

I have nothing saying that there was an agreement to refund expect courier tickets for sending the parcel back.

My next move was going to be sending an email saying if the moneys not refunded by X date then these will be the actions i'm taking, then follow it up with a phone call.

Or i was thinking it could be a cash flow problem and then saying i would allow any of the following parts as full payment: X

But yea I've never really been in this place before so don't know what to do.

i had the same issue with a raidiator (v5 std raidiator for auto wrx), i got my partner to pick it as i was out of town, when i got home, i looked at it, and saw that the side tanks were rooted, so i called him many times, they tryed to say that it was mint when it was picked up blah blah. once i had some spear time, i payed them a visit, they didnt f**k around getting another 1 out for me

Masterton...theres your problem. Haha

If hes a Subaru specialist why does he not like dealing in Version numbers? Its the simplest way to id them.

just reading there web site,

The workshop is equipped with modern equipment including a forklift, hoist, steam cleaner and oil draining equipment. App parts inside the building are computer tagged for easy access and information.

Pretty much, thats what i was thinking. Should have stop dealing with them then in hindsight.

Found them on trade me, Didn't see the website till after buying off them and wondering wdf was taking so long

Hi Brock,

Obviously phone calls are not working, Hence i'm sending an email to try resolve it.

I'm sick of ringing up and being lied to and being told it will be done today etc.

If the money still isn't in the bank account from my previous email, by next Tuesday (the 10th) i will be seeking legal advice as to ways i can get the refund of $170 back.

If cash flow is the problem then i will accept one of the following parts as full payment:

Dccd center diff inside the rear housing

Set of 1999 yellow top injectors in the rails (including fuel reg)

Set of lowering springs to suit a BE5 Legacy

I will be following this email up with a phone call this afternoon if i get no reply. Let me know if you want put threw a full refund or want to work out a deal.

i think the lesson here is....do not buy parts from wreakers out of town. shit happens, and unfortanty it happened to you...

hopefully you can resolve the issue with out having to take legal action, in saying that, good luck pl0x, and hopefully the prick wont cause any more issues

Yea i agree haha, warning bells should have gone off (dealing out of trademe etc) but i've been lucky with most wreckers before so didn't mind it.

Hopefully he comes threw with the money lol, will post final result here.

Have you spoke to the actual company owner?

Do a search for directors at www.companies.govt.nz.

If you speak to the money man you might get more traction.

As Swindog said just be firm and fair. Its not time to get obnoxious and threatening yet.

what kind of retard treats their paying customers like that?

The conclusions you draw are that this is a poorly organised hillbilly type operation, with an owner who is pretty much illiterate and incompetant.

Just reply something like "Hi, I am not trying to push you and I appreiciate that you are having a tough time right now. The point remains that I got the wrong goods, and have since sent them back to you. Please put the funds into my account as soon as possible, as I need the funds right away.

Who buys parts over the phone? I do. If he had his computer labelled parts system running or even in existence it wouldnt matter weather you bought it over the phone, by inked letter or fuckin carrier pigeon.

The guys a smear in my $5 kmart underwear.

      Afternoon team,
      im new to the group first time posting. Im hoping some body can help me get my launch control all dialled in on my link g4x. Ive had the computer and car all tuned from chris at prestige awesome knowlegable guy super happy with the results but now im wanting to get my launch/anti lag all dialled in. Ive been reading multiple different forums etc all with different conflicking information which has made me nervious with what do i listen to this or that if you get what i mean. Now ive started to make myself familiar with my PClink software etc the past few weeks and im eager to learn how to do minor setups or tweaks etc so im not relieing on my tuner so much and obviously saving myself abit hurt in the back pocket. 
      Now back to the question at hand.... Im wondering if theres and one who could please share there knowledge and wisdom with setting all my values, timing, fuel etc when i have launch control armed and engaged, or even a launch tune file they can possibly send me to load onto my tune. Ive figured out the setup of my digital inputs turning launch control on etc and its obvisously on its pre set factory settings. It engages but doesnt sound the greatest or as angry as it should i feel. Hence reaching out to you good buggers.
