insurance question

One of my drivers had a brain explosion just before xmas and crashed his car.

Does anyone know if insurance pays out if speed was a factor in the accident?

Anyone with hard earned experience in the matter maybe?

Theyll wanna see the police report if there was one or accepted liability by the driver. They should still pay out but will depend on the speed one would suggest.

That was kind of what I thought also.

He says he doesn't know but I would guesstimate 70ish in a 50 zone. He's being charged with careless driving.

While that's obviously serious I'm thinking in the grand scheme of things its not the end of the world.

Yeah i would say talk to the insurance company and read your insurance contract for a better idea. They may, they may not. Insurance is there for when people stuff up. Everyone makes dumb decisions.

Im assuming you mean a license dispensation?

Its for any time, depends on his work hours. If hes on shift its for his shift hours. If its 730 to 530 its for 730 to 530 only. Work dispensation yeah thats it. Mind you, if its loss of demerits he wont get it.

last time i was DQ'd was thinkng about this temp work license and they rekn i had to wait a month then pay $1000

They may not take his licence depending on the seriousness of the charge. I've had careless driving x2 and they only took my licence once (the first charge). Tips from my expensive lawyer are to go do a driving course before the court hearing to prove that he is sorry and actively changing his ways. Then ask for an increased fine in lou of losing his licence.

Well hes had a few tickets but nothing serious before so im thinking he might get diversion.

Poor kids pretty broken up over it, hes owned a few crappers and he just went and wrote off the first nice car he has ever owned. Im hoping with the fact it was legit, insured etc he will get off a bit light.

depend if alcohol is involved :o then hes fu#ked :-\

and if its his 1st offence then diversion is highly likely but in saying that coz its a crash if they find him at fault then he's most likely to get a 3-6 month DQ'd but then again if you get diversion you shouldn't get anything else coz thats the way it works, like a second chance.

what i usually do when i going up to court is make sure no one pi$$es the judge off before i go up, you dont really wanna go up in frnt of a $hitty judge :

and as for the speeding its not like they gonna get the SCU (serious crash unit)

ok i doubt he will loose his licence for careless driving, i have been charged with careless 3 times in my younger days and never lost it, i believe i did inherit around 50 demerit points though and a decent fine.

oh yea and one of those times i was ordered to do a defensive driving course which was sweet as cause i used that same course to cut down my restricted licence period, which i was going to do anyway, haha.

but im a good boy these days ;D
